§ 8.04.100. Notice

  • Any person found by the public officer to be in violation of Section 8.04.080 shall be sent a notice of such violation by the public officer. The notice shall be sent by certified mail, postage prepaid, return receipt requested. The notice shall state:

    A. The condition which has caused the violation of this chapter; and

    B. That the person in violation shall have:

    1. Fifteen (15) days from the date of the mailing of the notice to alleviate the exterior conditions (yard) violation, and/or

    2. Forty-five (45) days from the date of the mailing of the notice to alleviate the exterior conditions (structure) violation, or in the alternative to subsections (B)(1) and (2) of this section,

    3. Fifteen (15) days from the date of the mailing of the notice to request, as provided in Section 8.04.140, a hearing before the governing body on the matter; and

    C. That failure to alleviate the condition or to request a hearing may result in prosecution under Section 8.04.110 and/or abatement of the condition by the city according to Section 8.04.120 with the costs assessed against the property under Section 8.04.120
