§ 2.12.040. Bonds required

  • A. The commission is authorized to fix by resolution the amount and condition of any surety bond to be given by an officer or employee of the city before entering upon the duties of his or her office or employment, except as may otherwise be required by law. The bond shall be conditioned for the faithful performance of all the duties of his or her office or the officer or employee executing the same. The commission may, at its discretion, increase the amount of any bond or may require bonds of other officers or employees as it may deem expedient.

    B. Each member of the board of commissioners shall, before entering upon the duties of his or her office, give a good and sufficient surety bond for each term of office to be executed by a responsible bonding company authorized to do business in Kansas, payable to and for the use and benefit of the city, in the sum of five thousand dollars ($5,000.00), conditioned for the faithful discharge of his or her duties, and that he or she will save the city harmless from all loss caused by his or her neglect of duty or malfeasance in office, or for the wilful expenditure or misappropriation of any moneys, property or equities of such city in violation of law; the bonds in each case, before being accepted, shall be approved by a judge of the Pratt County district court.

    C. The city manager shall give a bond to be approved by the board of commissioners in the amount of five thousand dollars ($5,000.00) and with the same conditions as prescribed for the board of commissioners.

    D. The governing body may provide for the coverage by blanket bond of such officers and employees and in such amounts as the governing body may, by resolution, designate.
