§ 15.04.090. Code enforcement

  • Whenever it shall be found that any building or structure is being, or has been, constructed in violation of the provisions of this code, the building inspector shall notify the owner, agent, or the contractor engaged in erecting such building or structure of the fact that it is being, or has been, constructed contrary to the provisions of this code, and shall specify briefly in the notice the violations, and shall require the person so notified to forthwith make the building or structure conform to the provisions of this code within the time specified in the notice.

    If, at the expiration of the time set forth in the notice, the person so notified shall have refused, neglected or failed to comply with the request made in the notice to have the building or structure changed so as to conform with the provisions of this code, the building inspector shall have authority and it shall be his or her duty to refer the matter to the city attorney for prosecution.
